Man who killed many people at tavern justified his action via Affidavit

The incident took place at Pienaar tavern where Bongani Nkosi claimed several lives during the shooting.

Bongani’s lawyer Nkosingiphile Maluka confirmed that his client was trying to defend himself during the incident.

According to the report by Daily Sun on Wednesday, Bongani stated that on the day of the incident, he was with his uncle at Levisa Bar Lounge, and when they were preparing to settle, a VW Polo arrived at the venue with armed individuals.

He alleged that the victims began firing randomly into the air and in the direction of other patrons, including himself and his uncle.

He further explained that the individuals appeared to act with a common purpose, as another group in a different vehicle began shooting as well.

He narrated that while they were hiding, one of the armed individuals walked towards the gate where his car was parked wielding a firearm with an extended magazine that was fully loaded.

He added that the individual began firing shots and waved a sign in a tsotsi style, indicating that he was coming back.

He stated that “Therefore, as a result of the imminent danger towards me and those around me, I then responded in self-defence to protect myself and those who were shouting for help at the same tavern.

“I took my gun and started firing shots, and unfortunately, I was unaware of how many were deceased at the scene. It all came to my attention when I was informed of the charges.”

During the court day Bongani requested with the court to release him on bail, citing his responsibility to his family.

He also stated that he had no knowledge of the witnesses and had no intention of endangering their lives.

His wife, Rianah Mshwane, took the stand and expressed the hardships she faced due to her husband’s incarceration.

She stated that her marriage may never be the same if Bongani remains in custody, as he is her main support system.

During the stand Sergeant Ben Nkambule convinced the court otherwise regarding bail for Bongani.

He testified that the accused and his uncle who is also a co-accused in the case deliberately shot at the victims.

During the investigation more than 45 cartridges were found at crime scene on the day of the incident.
